Product warranty.

• Improper installation, including inadequate structural support, fastening, ventilation or gaps; failure to follow Sungem’s installation guidance.
• Use beyond normal service conditions, or applications not recommended by Sungem’s guidelines and local building codes.
• Movement, distortion, collapse or settlement of the ground or supporting structure.
• Natural disasters such as floods, hurricanes, earthquakes and lightning; environmental conditions such as air pollution, mould and mildew; staining from non-food or non-beverage substances; normal weathering.
• Improper handling, transport or storage; abuse, vandalism, intentional damage or inadequate maintenance by the purchaser, a transferee or third parties.
• Decay caused by fasteners, ordinary wear and tear, repair or alteration, impact from objects, and causes other than manufacturing defects attributable to Sungem.

The specific stain-resistance conditions above apply to claims concerning food, beverage, mould or mildew stains.

• Effects of direct or indirect exposure to extreme heat sources above 135°C / 275°F, including fading and surface damage.
• Surface damage or punctures void the warranty. Do not use metal shovels or sharp-edged tools to remove snow or ice.
• Applying paint, solvents or other coating materials voids the warranty.
• Colour variations or changes, including slight differences and uneven discolouration caused by rugs, mats or other objects preventing uniform exposure to sunlight and the elements.

Stains are excluded when the required cleaning is not completed within one week. Excluded substances also include:

• Acidic or alkaline abrasive compounds, paints, stains, strong solvents and metallic rust.
• Abnormal deck-use items and non-food or non-beverage substances, including biocides, fungicides, plant food, bactericides, cement, concrete, mortar, stucco and coloured chalk.

Mould and mildew can grow on any outdoor surface. Stains from mould or mildew not properly cleaned within one week of first appearance are not covered.

The warranty does not cover costs of removing defective products or installing replacement materials, including labour and freight.

Products donated, bought on clearance, at promotional prices or at auction are not covered.

Information or suggestions about applications, specifications and compliance with codes or standards, including building and safety codes, are provided for convenient reference without a representation of accuracy or suitability. Purchasers must verify and test suitability for their specific application.

Installation and Care & Cleaning Guides are available from Sungem or an authorised distributor, agent, dealer or importer.

To the fullest extent permitted by law, Sungem excludes special, indirect, incidental, consequential, reliance, statutory, punitive and exemplary damages, including lost profit, use, time, revenue, business opportunities, goodwill or reputation, and inconvenience, in connection with the sale, delivery, installation, use or loss of use of the products, or the purchaser’s liability to third parties.

These exclusions apply whether a claim arises in contract, tort (including negligence and strict liability) or otherwise, even if the damage was foreseeable or Sungem was advised of its possibility. Liability for non-personal-injury claims relating to defective products does not exceed replacement of the products or refund of their purchase price as described in the warranty.

The limited warranty is the only warranty Sungem makes for these products. Sungem disclaims other express or implied warranties, including merchantability or fitness for a particular purpose. The purchaser assumes the risks resulting from use of the products, alone or in combination with other products or substances.

The limited warranty can only be changed by a written instrument signed by Sungem and the purchaser. No person or entity is authorised to bind Sungem to statements about product quality or performance beyond this warranty.
